Unblocking Prefecture Files

Urgently have your file unblocked by the prefecture

For individuals who urgently need a document authorizing their presence and employment in France and/or allowing them to travel while the prefecture processes their renewal application and prepares their new residence permit.

The prefecture hasn't responded to you, and you don't know if it will respond before your employer terminates your employment contract or before your travel date?

File an urgent petition with the court to protect your job and/or your trip

Several conditions must be met to perform this procedure.

In particular, you must have contacted the prefecture several times to alert them to your situation.

To find out if you are eligible for this procedure, take this eligibility test:

I will take immediate action by filing a petition with the court to resolve the hold on your case at the prefecture

You will then quickly receive a document from the prefecture authorizing you to work and travel

Processing times at prefectures for obtaining a residence permit

Lack of documentation allowing you to work, travel, and stay in France

If the prefecture does not respond to you or does not issue the correct document, you cannot prove your right to work in France, and you cannot travel while the prefecture is processing your application.

However, the processing times at the prefectures for obtaining a residence permit range from six months to one year.

While the prefecture is processing your application, it must issue you a document authorizing your presence in France and allowing you to travel in accordance with French law.

But in practice, it does not always issue this document.

Would you like to discuss your various options together ?

The purpose of this procedure is to compel the prefecture to issue this document to you as quickly as possible, before you lose your job or are forced to cancel your trips.

Book your consultation (online or in Paris) and leave with a clear, personalized solution to your problem.

File an emergency petition with the court

If your case warrants it, I will then file an urgent petition with the court to compel the prefecture to act quickly. As a result, your situation is usually resolved within a few weeks.

I can handle the entire process 100% remotely and file your case with any court in France (both mainland France and the overseas territories).

Steps

administrative silence from the prefecture

1. No response from the prefecture

The prefecture has not responded to you, even though your employer is asking you to provide proof of your status in France and/or you need to travel soon for work or to visit your family.

court filing deadline: three to five days

3. I will file a lawsuit within two to four days

If you meet the requirements and would like to proceed with this process, we can then begin the process.

As soon as I receive your payment, I'll send you a link to download all your documents from my platform.

I'll review all your documents, prepare my petition, and ask you for additional documents to strengthen your case.

I will then file my request as an urgent matter. I will then send you the document proving that you have filed the case with the court (which you should always keep with you).

official letter with a stamp from the prefecture

4. Response from the prefecture within one to three weeks

As soon as I file a lawsuit, the prefecture receives a notice. It’s important to know that if the case is lost, the prefecture is required to compensate you by paying you a sum of money.
To avoid paying this sum, the prefecture will very often contact you one to three weeks after we file our petition in order to resolve your issue immediately. They will summon you promptly to issue you a receipt.

court response time (months)

5. The court will respond within one to two months

The court issues its ruling within one to three months on average.

If you win the case, the court will order the prefecture to issue you, on an emergency basis, the document authorizing your stay in France and/or your right to work. The judge may also
award you a sum ranging from 600 to 900 euros as compensation (only if you win the case).

Frequently Asked Questions

My situation is very urgent: will this solve my problem in time?

Filing a lawsuit is the fastest way to get an urgent response from the prefecture. Depending on your situation and the court with jurisdiction over your case, I can advise you on the actual processing times.

Will taking the matter to court or consulting a lawyer have negative consequences for my case later on?

This procedure is initiated daily by several hundred people; it is, therefore, a completely standard process. There is no need to hesitate to file a complaint with the court: doing so will compel the prefecture to fulfill its legal obligations.

In practice, this also leads the administration to handle the case with greater care in order to avoid a possible conviction.
