Visa and Residency Permit Attorney
Expatriates: Are you interested in moving to France on a visa?
Obtaining a long-stay visa allows you to settle permanently in France.
These visas are valid for one to four years, depending on the type of visa applied for. Some must be validated within three months of your arrival in France.
Before your visa expires, you can apply to renew it and convert it into a residence permit so that you can settle in France permanently.
France is a very attractive country. In 2024, more than three million visa applications for France were submitted.
After living in France for five years, you may then apply for French citizenship.
Which visa or residence permit is best suited to your situation?
New Title
France offers a wide range of visas tailored to each individual situation.
You can apply for a visa on several grounds:
Specific rights associated with each type of visa
French immigration law is based on the Code on the Entry and Residence of Foreigners and the Right of Asylum (CESEDA), which provides a clear framework, even though in practice these rules are not always followed by prefectures and consulates.
The rights associated with each visa or residence permit are strictly defined by law. In particular, they determine whether or not you have the right to work, start a business, bring your family to France, receive social security benefits, and, eventually, obtain long-term residence status or French citizenship.
The Importance of Determining Which Type of Visa Is Right for You
Several negative consequences in the event of an error:
- If the visa you receive isn't appropriate for your situation, it takes an average of 6 months to change it directly in France. During that time, your project cannot move forward.
- If you apply for a visa with a validity period that is too short, you will not be able to renew it in France and obtain a new residence permit once your visa expires.
- The Consulate can only issue you the type of visa you are applying for. It cannot issue you a different type of visa that might be more appropriate for your situation.
- In some cases, you are required to return to your home country to apply for a new visa and start the process over from the beginning.
Once you're in France with the wrong type of visa, it's hard to correct that mistake.
- If your visa application is denied, that denial will remain on your record, and you will have to start the process over from the beginning.
Therefore, it is important to make sure that the type of visa you are applying for is the one best suited to your situation in order to ensure the success of your plans.
Whether your project is personal, family-related, or professional, I can help you choose the right visa, put together a strong application, and ensure a smooth transition to France.
Why are visa applications often denied?
Visa denials are most often due to:
A Stay with Little Justification
Travel/Health Insurance That Does Not Meet the Requirements
Incomplete or inconsistent documents
Insufficient financial resources
If my visa application is denied: Should I file an appeal?
It is not always strategically sound to file an appeal against a decision to deny a visa
If you wish to appeal a visa denial, you may challenge the denial before the Appeals Commission for Decisions Denying Entry Visas to France within thirty days of receiving notice of the decision. The Commission then has four months to respond to you. If your appeal is denied or if the Commission fails to respond within four months, you then have two months to file a lawsuit with the Administrative Court of Nantes (the only court with jurisdiction over this type of appeal).
The appeals process can be lengthy and uncertain, with no guarantee of a favorable outcome, which may unnecessarily delay any new relocation plans. Under these circumstances, it is sometimes preferable to focus efforts on submitting a new, more comprehensive, and better-supported application in order to significantly increase the chances of obtaining the visa.
It depends on your situation. During a consultation, I could quickly let you know whether filing a claim is the best strategy in your case.
Why should you work with a lawyer to obtain a visa?
The immigration process in France can be complex for the following reasons:
- the lack of reliable information online,
- specific legal rules that are little known,
- the requirement for specific documents,
- sometimes long processing times amid uncertainty,
- and a high risk of rejection if the visa application is inappropriate, contains errors, or is incomplete.
Consulting a lawyer early on allows you to:
- to avoid costly mistakes,
- to submit an application that complies with French requirements,
- to learn about consular practices in advance,
- to significantly increase your chances of obtaining your visa,
- and save time and enjoy greater peace of mind.
In a 15-minute consultation with a lawyer, you'll make more progress than you would in 10 hours of online research.
